This applies whether the claim is based in contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not the Alpine Parties have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, the total aggregate liability of the Alpine Parties for all claims arising out of or relating to this website or these Terms will not exceed one hundred United States dollars (US $100.00). This limitation applies in the aggregate across all claims and all causes of action, and it is not increased by the number of claims brought.

The limitations in this Section apply even if any limited remedy is found to have failed of its essential purpose. You acknowledge that these limitations reflect an agreed allocation of risk between you and Alpine and form a basis of the bargain on which this website is made available to you without charge.

You agree to indemnify and hold Alpine harmless from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your misuse of this website or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of this website will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction.

We may revise these Terms at any time. The effective date above reflects the current version. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision will be modified to the minimum extent necessary to render it valid, legal, and enforceable while preserving its original intent. No failure or delay by Alpine in exercising any right, power, or remedy under these Terms operates as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy precludes any further exercise of it or of any other right, power, or remedy.

A waiver is effective only if made in writing and signed by an authorized representative of Alpine, and it applies only to the specific instance and purpose for which it was given.

Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without Alpine's prior written consent. Any attempted assignment without that consent is void.

Alpine may assign or transfer these Terms, in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, financing, corporate reorganization, or sale of all or substantially all of its assets. These Terms bind and benefit the parties and their permitted successors and assigns.

Survival

The following Sections survive any termination of these Terms or of your access to this website: Section 3 (No professional advice), Section 4 (Accuracy of information), Section 5 (Forward looking statements), Section 6 (Intellectual property), Section 9 (Securities and bondholder information), Section 10 (Disclaimer of warranties), Section 11 (Limitation of liability), Section 12 (Indemnification), Section 13 (Governing law), and Sections 15 through 20. Any other provision that by its nature is intended to survive will also survive.
